Terms of Service

1. Service provider and legal framework

These Terms govern your purchase and use of Malvine prepaid digital access. The service is provided by a sole trader registered in the Republic of Serbia:

Malvine is an information society service within the meaning of the Serbian Electronic Commerce Act. The mandatory provider information required by Article 6 of that Act — name, address, contact details, registration data and tax number (PIB) — is set out above and in the footer of every page.

These Terms and their performance are governed by the law of the Republic of Serbia. If you are a consumer, the mandatory law of your country of habitual residence applies in your favour regardless of that choice.

2. Service — software only

Malvine is computer software delivered as an online web application at malvine.online. Your purchase grants time-limited access to use the software. No physical goods are shipped.

Malvine is a self-service research and workflow tool. We do not sell third-party promotion, human professional services, or standalone document-authoring products.

Your purchase transfers no rights in the software: you receive the right to use it for the period you paid for, with no resale of access, sublicensing, or sharing with third parties.

3. Prepaid access and pricing

• Access starts when your payment is confirmed and entitlements are granted.
• Current plans: 7-day pass (€5) and 30-day pass (€15).
• Plans are prepaid for a fixed period; access does not auto-renew.
• Additional purchases add days to your access end date; they do not create separate refundable balances per order.
• After expiry, the app may limit features until you purchase again.
• Price, period, the absence of auto-renewal, and the withdrawal rules are disclosed before purchase — Article 27 of the Consumer Protection Act requires this for distance contracts.
• Prices are stated in EUR and are final: taxes are included, and their amount is shown at checkout before payment; the purchase carries no other charges (Article 6(2) of the Electronic Commerce Act, Article 12(1)(3) of the Consumer Protection Act).
• A promo code, if you apply one, lowers the price at checkout; the final amount with taxes is shown before payment.

4. Payment and merchant of record

Checkout and payment processing are handled by Dodo Payments as Merchant of Record: the contract of sale is concluded with them and their buyer terms apply to the payment. These Terms govern the use of the software itself and the entitlements we grant.

We do not store full card numbers. The access period you paid for is shown in your profile.

5. Acceptable use

You must use the software lawfully for personal research and workflow. You may not scrape, resell, or misuse the service or attempt to circumvent access limits.

6. Consumer rights

If you buy access as a consumer, you have the right to withdraw from a distance contract within 14 days without giving a reason — Article 29 of the Consumer Protection Act. The procedure, the deadline and the statutory exception for digital content are described in our Refund Policy.

If the software does not match its description, send a complaint (reklamacija) to info@malvine.online. We reply within 8 days, as the Consumer Protection Act requires, stating whether we accept the complaint and how we resolve it.

If our answer does not satisfy you, the dispute can be referred to a body for out-of-court settlement of consumer disputes from the List kept by the Serbian Ministry of Internal and Foreign Trade. Participation is mandatory for us, and we do participate.

7. Personal data

We process personal data as a controller under the Serbian Personal Data Protection Act. What we process, why, on which legal basis, who receives it, and how you control it are all set out in our Privacy Policy.

8. Limitation of liability

The service is provided as-is to the extent permitted by applicable law. We do not guarantee any career outcome. For purchases made otherwise than as a consumer, liability is limited to the amount paid for the access period giving rise to the claim.

For consumers that cap does not apply to the extent it would limit their rights on our total or partial failure to perform: Article 46(1)(1) of the Consumer Protection Act treats such a clause as unfair irrespective of the circumstances, and Article 45 declares unfair terms void.

Nothing that cannot be limited is limited or excluded: conformity of digital content and digital services with the contract (Article 74), the trader's liability for non-conformity (Article 77) and the consumer's remedies for non-conformity (Article 80), remedies for failure to supply (Article 79), death or personal injury (Article 46(1)(2)), compensation for material and non-material damage under the Personal Data Protection Act (Article 86), and liability for intent and gross negligence.

9. Governing law and disputes

Governing law is the law of the Republic of Serbia. The mandatory law of your country of habitual residence applies regardless of that choice.

If you are a consumer, disputes are heard by the court of your own domicile: the seller's-seat venue clause does not apply to consumers — Article 46(1)(6) of the Consumer Protection Act treats it as unfair irrespective of the circumstances of the case, and Article 45 declares unfair terms void.

For purchases made otherwise than as a consumer, disputes are heard by the court with jurisdiction at the seller's seat in Novi Sad, Republic of Serbia.

Before going to court, please write to us: most questions are settled by email, and out-of-court consumer proceedings take up to 90 days.
